David S. Gesner

Dave Gesner focuses his practice on assisting with patent preparation and prosecution efforts, primarily in the areas of software, storage technologies, and business methods; on preparing infringement and validity opinions; and on counseling relating to product design and development.

• Assisted with due diligence performed by Fortune 100 records management company in connection with acquisition of software company.
• Assisted Fortune 100 defense contractor with defense against patent infringement claims by competitor by drafting opinions of non-infringement and invalidity of competitor’s patents.
• Assisted with development of patent strategy for medical software company and assisted with the drafting and prosecution of patent applications before the U.S. Patent and Trademark Office.
• Assisted foreign company considering entry into U.S. market for printer toner cartridges in assessing barriers to entry posed by competitors’ patents, and counseled on product design changes to minimize infringement risk.
• Assisted in development of patent strategy for startup recycling technology company assisted in preparation and prosecution of patent applications before the U.S. Patent and Trademark Office, and counsel of client on risks and opportunities associated with entry into new lines of business.

Dave worked for over 10 years as a software consultant, developing and implementing large-scale database marketing systems, multi-tiered internet architectures, and data analysis tools, mainly for Fortune 100 clients.

Immediately prior to joining Wolf Greenfield, Dave served as a Senior Manager at Agency.com, where he oversaw the detailed system design and implementation of such major business-to-consumer web sites as Reuters.com and Genuity.com.

Dave also served as a Director at Epsilon, where he oversaw the design, development, and implementation of database management, storage, and networking technologies to support the database marketing efforts of clients such as American Express and GTE.
