Ilan N. Barzilay

Ilan Barzilay practices in all areas of intellectual property law with a focus on litigation of patent and other IP rights. He also counsels clients on a variety of matters including patent and trademark prosecution, portfolio development, opinions, and licensing.

Ilan’s experience covers a wide variety of technologies from microelectromechanical systems (MEMS), database management, and financial services software, to flexible sprinklers and medical devices, to equestrian hoof-pads and consumer products. He has represented clients of various sizes, from established corporations to research institutions to emerging companies. He has successfully litigated against both the largest hospital company in the world and the largest furniture company in the world.

Representative Matters

Defended large retailer against infringement charge on patent related to telephone handset technology resulting in summary judgment of non-infringement.
Represented small fabric manufacturer against Ashley Furniture for copyright infringement of client’s most popular fabric line. After discovery across the U.S., as well as in the U.K. and Hong Kong, the case entered into a confidential settlement the morning of trial.
Defended Bridgewater Candle against Yankee Candle, prevailing in both the District Court and the First Circuit and leading to an attorneys’ fee award of over $1 million for Bridgewater, in what has become one of Massachusetts’ leading trade dress and copyright cases.
Developed and managed IP portfolio for startup financial services client including multiple patent families, house and product trademarks, and re-examination of flagship patent.
Obtained summary judgment of infringement for same financial services company against competitor on patent for data mapping.
Obtained a settlement and agreement for future services for a local software company after filing suit against a large hospital conglomerate for unauthorized use of the client’s medical data archiving software.
Secured transfer of numerous internet domain names through arbitration (UDRP) proceedings.
Represented individuals who were fraudulently listed as contact information for a scam website resulting in the shutdown of the website.

For several years Ilan coached the Wellesley College mock trial team, taking the team to a 1st place standing in national competition. Ilan regularly judges local and national moot court and mock trial competitions.

Ilan coordinates the firm’s Summer Associate Program and speaks at local law schools on IP issues. He also performs in the occasional community theater/chorus production.
