Lawrence M. Green

Larry Green is experienced in patent and trademark prosecution, preparing clearance, validity, patentability and pre-litigation opinions, handling patent interferences, and managing litigation. His practice is focused on all aspects of intellectual property in various mechanical technologies, including medical products, laboratory equipment, textiles, and manufacturing apparatus and processes.

Representative Matters
  • Successfully managed Cooper v. Goldfarb, the longest running patent interference in U.S. history. This 18-year conflict involved three appearances before the Board of Patent Appeals and Interferences, and two appeals to the U.S. Court of Appeals for the Federal Circuit.
  • Successfully represented University of Iowa before USPTO Board of Patent Appeals and Interferences and the Court of Appeals for the Federal Circuit in an interference proceeding involving the use of polynucleotides to treat allergy by selectively stimulating the immune system. The Federal Circuit decision made new law regarding the duty of an applicant to provoke an interference with a patent.
  • Successfully represented MIT against Affymetrix in an interference in the USPTO with respect to methods for detecting genetic defects.
  • Briefed and argued three litigation related appeals to the U.S. Court of Appeals for the Federal Circuit, one being the seminal case of Vitronics Corporation v. Concentronic, Inc.
  • Briefed and argued three ex parte appeals to the U.S. Court of Appeals for the Federal Circuit, one being In re Sullivan, overturning a board decision of obviousness.
  • Second-chaired five patent infringement trials, three of which were jury trials.
