Richard F. Giunta
Rich Giunta has over 18 years experience and handles all areas of patent practice, including patent prosecution, litigation, counseling, interferences, due diligence, clearance studies, infringement and validity opinions, licensing, and reexaminations.
Rich’s litigation and opinion experience benefits his patent prosecution clients in obtaining commercially valuable and enforceable patent rights. Similarly, he brings significant patent prosecution experience and perspective to patent litigation. He has particular expertise in handling parallel proceedings in the federal courts and the U.S. Patent and Trademark Office.
Rich’s experience as a senior design engineer in the computer field enables him to offer particular expertise in handling all types of computer and software related technologies. Rich also has extensive experience in handling other diverse technologies in the electrical, medical device, and consumer products fields.
Examples of the technology areas in which Rich has worked include storage systems, digital rights management systems, automatic availability systems, databases, semiconductor processing, imaging devices, healthcare software systems, wireless networking systems, computer aided tomography, explosive detection devices, graphics systems, guidewires, stents, catheters, and snowboard equipment.
Rich represents a full spectrum of clients, including industry leading multi-national corporations (e.g., EMC, Microsoft, ST Microelectronics, L-3 Security and Detection Systems), mid-size companies, start-ups, venture capitalists, and academic institutions.
- For over 15 years, has assisted EMC in developing their extensive patent portfolio.
- After discovering a client’s previous counsel had neglected to pursue two valuable aspects of the client’s technology, worked with the client to obtain protection for those concepts, one of which has formed the basis for an industry-wide licensing campaign.
- Represented various clients in numerous reexamination proceedings being pursued in parallel with pending infringement litigation in the federal courts and, in each case, successfully strengthened client's rights.
- Counseled start-up companies in a variety of fields in identifying the best use of limited resources to obtain patent protection suiting their unique business goals.
- Assisted industry leading client in developing and implementing an industry wide licensing program, which included second chairing litigations against two of the competitors, both of whom ultimately settled on terms more favorable to our client than the standard terms initially offered.
- Participated in 10 appeals to the Federal Circuit from patent infringement actions.
- Assisted in trade secret and patent infringement litigation against a new start up formed by a client’s former personnel. When defendant alleged the trade secret had no value, "mined" the client’s portfolio to obtain a patent on the concept on expedited basis, creating significant leverage in the trade secret case as well as infringement exposure that facilitated a favorable settlement.
Prior to joining the firm, Rich spent six years as a hardware design engineer at Wang Laboratories. He was a member of the VS1000 CPU design team and had lead responsibility for several ASICS. Rich was also responsible for designing a patented interface for a main memory board.

Rich has been recognized in Chambers USA as a leading intellectual property attorney. While in law school, he received both the Daniel J. Fern Award, for graduating first in his class, and the David J. Sargent Fellowship, a full tuition scholarship awarded to one member of each entering class.
Rich was an Academic All-American Football Player at Tufts University and a recipient of the Alumni Association Seniors Award, awarded to 12 graduating seniors based on academic performance and demonstrated leadership, and the Frederick Melvin Ellis Prize, awarded to students showing marked athletic versatility, a modest manner, successful academic achievement, and the potential for effective leadership of youth.
Rich was the lead inventor on a patent for a memory diagnostic system.
Rich has held several leadership positions at the firm, including the firm’s management and strategic planning committees and chair of the firm’s training committee.
Rich has always had a passion for athletics (captaining his high school football and lacrosse teams and his college football team) and continues that involvement by coaching his children's youth teams.
