Wolf Greenfield wins $17M patent infringement settlement from Kraft for our client Keurig

LITIGATION SUCCESS

Our client Keurig (a wholly-owned subsidiary of Green Mountain Coffee Roasters, Inc.) sued Kraft Foods Inc. in Delaware federal court for infringement of a Keurig patent directed to a type of cartridge used in beverage machines. The Kraft products in dispute were Kraft's Tassimo T-Disc cartridges. We successfully opposed Kraft’s attempt to obtain summary judgment of patent invalidity and non-infringement, and we prepared the case for trial. We retained an engineering professor from MIT to testify regarding infringement, as well as his tests of the prior art asserted by Kraft.  We also retained a leading figure in the coffee industry to provide expert testimony regarding the T-Disc and the asserted prior art.

In October 2008, with just a week remaining before trial and significant pre-trial evidentiary motions pending before the Court, Kraft agreed to pay our client a lump sum of $17,000,000 for a limited, non-exclusive license under certain Keurig patents directed to beverage machines and beverage cartridges.
