Wolf Greenfield Secures Litigation Victory for Ascion LLC
Our client, Ascion LLC, and one of its biggest customers, TempurPedic, were sued by Taiwanese supplier Ruoey Lung Enterprise Inc. for infringement on a patent directed to a type of adjustable bed. Our client countersued, claiming Ruoey Lung breached a commission agreement between the two parties. We employed a two-pronged approach, first invalidating Ruoey Lung’s patent through an inter partes
reexamination which concluded in September 2013. In January 2014, shortly before closing arguments in the breach of contract trial, the judge granted our client Judgment as a Matter of Law (JMOL) on one claim (quite unusual before a jury verdict,) after which the jury returned a verdict awarding our client $2.56 million.
